Greetings from the Compact! We are in the home stretch of winter now, and hopefully, all the major snowstorms are behind us. Wherever you are, I hope you see signs of spring soon.

First and foremost, you may have seen an announcement that we are not holding an in-person Joint Meeting of the Management Committee and Commission in Indianapolis next month. Instead, we will hold a virtual meeting of the Management Committee on March 18, and the Commission will convene virtually on April 1. Notice was sent out earlier today, so be sure to mark your calendars.

Are you a designated representative for your state? If so, we just held an orientation session for newly designated representatives and are conducting two sessions next week to provide a Compact Update for Designated Representatives (30 minutes) on Monday, March 3 at 1 pm ET / 12 pm CT and Wednesday, March 5 at 12 pm ET / 11 am CT. This program is geared towards providing an overview of current Compact activities for all designated representatives, and each session includes time for Q&A.

This is a friendly reminder that the amendments to allow non-employer groups are effective as of Monday, February 10 for group life products and Monday, March 3 for group disability income products. More information about how the process works can be found below.

So that our readers have an idea of the priorities of our Compact Board, we are starting off 2025 highlighting each Compact Officer. Allan L. McVey was appointed West Virginia Insurance Commissioner by Governor Jim Justice on March 21, 2017. He was then appointed by the Governor to serve as Cabinet Secretary of the West Virginia Department of Administration in January 2019. He served in that position until his reappointment as West Virginia Insurance Commissioner effective September 22, 2021.

Commissioner McVey is responsible for the regulation of the insurance market, as well as protection of insurance consumers. He believes in the mission of the West Virginia Insurance Commissioner’s office of promoting a competitive and solvent insurance market with adequate consumer protection by fairly and consistently administering the insurance laws of West Virginia.

Prior to his appointment in 2017, Commissioner McVey was a licensed insurance agent who served in several capacities during his long tenure in the insurance industry in West Virginia. His experience includes a position as a medical claims examiner with the West Virginia Workers’ Compensation Fund, underwriter with a large national insurance company and since 1976 a licensed insurance agent and broker with several firms, both local and national. His latest assignment included both sales and management of the West Virginia operations for a large national insurance brokerage firm.

Commissioner McVey earned a Bachelor of Science, Business Administration degree from West Virginia State University and has several post-graduate insurance designations.

Non-Employer Groups

The Compact Office released guidance pertaining to its handling of non-employer group filing submissions earlier last month, and we are beginning to see such filings coming through the door. We are committed to reporting filing activity to member states, and the Compact Office is reaching out to each Compacting State to better understand and record how member states want information about non-employer groups filings reported to them. The following are excerpts from Filing Information Notice (FIN) 2025-1 covering reporting requirements to Compacting States as well as submission requirements:

  1. Filers will identify group filings that will be issued with non-employer groups. They will be required to complete two submission requirements listing the group types and if applicable, the state filings or approval of the specific groups.
  2. If requested by a Compacting State, the Compact Office will notify the Department by e-mail when the Compact Office receives a Product Filing for approval in their respective Compacting State that will be used for or issued to non-employer groups.
  3. The Compact Office will maintain a listing of all pending Product Filings that are being used with non-employer groups and post this information monthly on a regulator-only site.
  4. The Compact Office will send a report to the Compacting State on a quarterly basis of the approved group product filing submissions that will be used for or issued to non-employer groups with a listing of group type identified.

We are currently looking for a Director of Regulatory Affairs. This position is full time, remote, and responsible for developing and overseeing strategies that align with member goals and promote robust member engagement and collaboration. The Compact Officers are hosting its seventh Roundtable event in Washington, D.C. on May 13, 2024, at 1:00 pm ET. It is scheduled to take place the day before the 2025 NAIC Commissioner Fly-In, so if you are already attending this event, we hope you consider arriving a day early to take part in what will be a great discussion about the Compact’s future. Legislative Spotlight

Meet Massachusetts State Representative David LeBoeuf!

David LeBoeuf is the state representative for the 17th Worcester District in the Massachusetts House, where he is in his fourth term on the Professional Licensure and Children & Families committees. David’s background is as a small business advisor, but as a lawmaker, he has taken a special interest in insurance policy, serving on the Compact Legislative Committee and on the Executive Committee of NCOIL and winning prompt insurance coverage for new state employees in the last legislative session. David is a graduate of Harvard College and is completing an MPA at Harvard Kennedy School.
